PIR2 Smartyze LLP, and its affiliates and subsidiaries (collectively, “SmartyzeDetect”, “we”, “us,” or “our”) takes your privacy seriously. This Privacy Policy describes how we collect, use, disclose, transfer, and otherwise process your Personal Information. It also tells you about your rights with respect to your Personal Information, and how you can reach us to update it or get answers to questions you may have about our privacy practices.

1. Scope

This Privacy Policy covers the processing of Personal Information related to SmartyzeDetect’s products and services (“Services”), including:

(1) website(s) that may be accessed at https://smartyzedetect.com/ or any of its sub-domains (“Sites”),

(2) services accessible through the Site(s) (“Web Apps”),

(3) software that may be downloaded to your smartphone or tablet to access services (“Mobile Apps”), and

(4) software that may be downloaded and installed on your computer systems to access services (“PC Apps”), and

Additional information on our privacy practices may be provided in other documents such as offer descriptions, supplemental privacy statements, or notices provided prior to or at the time of data collection.

2. Personal Information We May Collect

We obtain personal information relating to you from various sources such as described below. For the purpose of this Privacy Policy, “personal information” means any information that personally identifies you, such as your name, email address, or other data that can be reasonably used to infer this information.

Where applicable, we indicate whether and why you must provide us with your Personal Information, as well as the consequences of failing to do so. If you do not provide Personal Information when requested, you may not be able to benefit from our Services if that information is necessary to provide you with the Service.

a. Personal Information We Collect Directly From You

Registration. In order to use the Services, we may ask you to provide certain Personal Information when you create an account on SmartyzeDetect Web Apps, Mobile Apps or register PC Apps. We may ask you to submit the following types of Personal Information: first and last name, country, and email address.

Videos. For providing SmartyzeDetect’s Services, we collect, process, and store the videos that you take with camera systems ( which you have registered with SmartyzeDetect) for various time periods depending on your configurations, and settings. This may include capturing and emailing to you portions of the videos, as part of a notification or analyzing the data to identify motion or other events. We may process Personal Information from your cameras connected to SmartyzeDetect products so that we can send you alerts when something happens (like when a person is detected).

Audio. As part of your use of SmartyzeDetect products and services, we collect, process, and may store audio provided by you via the SmartyzeDetect Mobile Apps or PC apps. This may include audio clips recorded by you for the purpose of playback of the clip at the time of an alert or live audio which is only played back during a live view of a camera when initiated by you.

Customer support. We may collect information through your communications with our customer support or other communications that you may send us.

b. Information We Collect From Your Interactions With Our Products and Services

Diagnostic Information. We collect diagnostic information including IP addresses, and other non-personally identifiable information (for example, the user-agent of the browser accessing our websites or apps) about your device, from our PC Apps, Web Apps and Mobile Apps to improve the Services offered to you.

Product Usage. We collect information related to your use of our products and services, and statistics about the performance of SmartyzeDetect devices and services. This information may include error rates, usage frequency, feature usage and other performance information.

Cookies. We use cookies on some of our Sites to store your preferences relating to use of our Sites to improve your experience while browsing our Sites. We use Google Analytics on some of our Sites. Google Analytics employs cookies in order to facilitate an analysis of your use of our Sites. Third parties (e.g., Google reCAPTCHA) may also collect information using cookies.

c. Personal Information We Obtain From Other Sources

Federated Login. If you access our Services using one of our federated account logins (such as Google), we may receive Personal Information about you such as your name and email address. Any Personal Information that we collect from Federated Login accounts may depend on your account’s privacy settings at the identity provider.

Third party Personal Information. If you choose to provide us with a third party's Personal Information (such as name, email), you must ensure that you have the third party's permission to do so. Examples include (but not limited to) providing us with the names that you associate with account users, or names and email addresses inviting a user to share access to your account.

3. How We May Use Your Personal Information

We may use your Personal Information for the following purposes:

a. Provide you with the Service and communicate with you. We will use your Personal Information to deliver our Services and to interact with you directly.

b. Maintain, improve and develop products and Services. We will use your Personal Information to ensure our Services are working as intended and to make improvements to our Services. We will also use the information we collect in existing Services to help us develop new ones or to customize Services for you.

c. Internal data analyses. We use Personal Information for internal analytics to understand how our Services are used.

d. Protect our firm, prevent fraud and secure our products. We may use your Personal Information to protect our firm, our customers, or our websites.

e. Compliance with law. We may use your Personal Information as required by applicable laws and regulations or requested by any judicial process or governmental agency having or claiming jurisdiction over SmartyzeDetect.

4. How We Share Your Personal Information

We may share Personal Information in the following ways or as otherwise disclosed to you at the time of data collection:

a. With service providers. We may share Personal Information with our service providers who perform services on our behalf based on our instructions and in compliance with appropriate confidentiality and security measures. Examples of services include: sending service related communications based on your notification preferences to your e-mail address using an email service provider.

b. With friends and/family you invite. You can decide to share your SmartyzeDetect linked camera access to friends and/or family.

c. We may share information with any successor to all or part of our business. We may transfer or otherwise share some or all of SmartyzeDetect’s assets, including Personal Information, in connection with a merger, acquisition, or similar transaction, or in the event of insolvency or bankruptcy. Should such an event occur, we will use reasonable efforts to direct the transferee to use Personal Information you have provided to us in a manner that is consistent with this Privacy Policy.

d. We may share information for legal reasons. We will share Personal Information with companies, organizations or individuals outside of SmartyzeDetect if we have a good faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

1. meet any applicable law, regulation, legal process or enforceable governmental request

2. enforce applicable Terms of Use, including investigation of potential violations

3. detect, prevent, or otherwise address fraud, security or technical issues or

4. protect against harm to the rights, property or safety of SmartyzeDetect, our customers or the public as required or permitted by law.

5. Your Rights and Choices

You have certain rights regarding the Personal Information we maintain about you and certain choices about what Personal Information we collect from you, how we use it, and how we communicate with you.

a. You can opt out of receiving SmartyzeDetect notifications. To stop receiving SmartyzeDetect notifications (push messaging and e-mail), you may switch off notifications by using the setting under the Account section on the “Mobile App”. You can reverse this anytime by toggling the same setting to start receiving all notifications again.

b. You can choose not to install our applications. This choice may limit your ability to use the Services.

c. You can delete your account. However, if you delete your account, you may not be able to fully use the Service.

To update your preferences, delete your account or submit a request to exercise your rights under applicable law, please contact us as specified in the “How to Contact Us” section below.

6. Children’s Privacy

Our Products and Services are not meant to be used by anyone under the age of 18 (eighteen) years. Your use of products and services states that you are 18 (eighteen) years of age or older or using such products and services under supervision of your parent or guardian who understands and consents to this Privacy policy.

7. How We Protect Your Personal Information

We intend to protect the Personal Information entrusted to us and treat it securely in accordance with this Privacy Policy. We maintain administrative and technical safeguards to protect Personal Information against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the Personal Information in our possession. Please do note that no computer system, Internet, websites, wireless transmission is 100% secure. We encourage you to use caution when using the Internet. This includes not sharing your passwords.

Retention of Personal Information

We also take measures to delete your Personal Information or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it or when you request its deletion, unless we are allowed or required by law to keep the information for a longer period. We have established time limits for certain data deletion, taking into account the type of services provided in the context of the Services, the length of our relationship with you, and mandatory retention periods.

8. Payment

We use Razorpay (which is Payment Card Industry Data Security Standard compliant) for processing payments, when you purchase a license for PC Apps from SmartyzeDetect.

9. Third Party Services

The Service may contain features or links to websites and services provided by third parties. If you click on a link to a third party site, you will be taken to websites we do not control. Any information (personal or otherwise) you provide on third-party sites or services may be provided directly to the operators of such services and is subject to those operators’ policies, if any, governing privacy and security, even if accessed through the Service. This policy does not apply to the privacy practices of other websites. Read the privacy policy of other websites carefully. We are not responsible for these third party sites or services to which links or access are provided through the Service.

10. Update to this policy

We may update this Privacy Policy from time to time. If we modify our Privacy Policy, we will post the revised version here, with an updated revision date. We recommend that you visit these pages periodically to be aware of and review any such revisions. If we make material changes to our Privacy Policy, we may also notify you by other means prior to the changes taking effect, such as by posting a notice on our websites or sending you a notification.
